This Privacy Policy of Glyff project (hereinafter – Policy) is designed to assist a User with understanding how ESPHERE LAB LTD is a duly registered and is validly existing company incorporated under the laws of the United Kingdom (hereinafter the “Company”, “we”, or “our”) respects, collects, uses, stores, protects and discloses the information and data a user (the “User”, “you”) provides to the Company through websites and services of Glyff project (“Glyff”), located at glyff.io (hereinafter – the Website) and any other websites, including websites on a social net, or mobile applications, and all services, products and content provided or operated by Company in connection to Glyff.

The Policy applies to any and all information about User that the Company or its affiliates, including all persons belonging to the same group with Company, may obtain in the course of the use of any of Company’s official websites, social networks, applications, programs, products or services (above and hereinafter – Services) and during the performance of any agreements and contracts with the User.

By using the Company Services the User expresses his/her/it unconditional agreement with this Policy and the conditions of processing the User’s personal information contained herein. If the User does not agree with these conditions, the User should not use the Services.

User has to be living individual. User cannot be under 16 years old.

1. The information, which Company Collect

When User visits the Website or use the Service, the User may provide the Company with two types of information: personal information the User voluntarily disclose that is collected on an individual basis; and information collected automatically when the User uses the Website or the Services (collectively, the “Information”).

Company will collect Information from Users only if they voluntarily submit such information to Company or gave permission to collect the Information. Users can always refuse to supply personally identification information; however that it may prevent them from engaging in certain Service related activities.

2. The Personal Information

Personal information is collected only when voluntarily offered and solely for purposes that are clearly identified on the Website. Personal information means any information relating to an identified or identifiable natural person, such as the User:

  • E-Mail address
  • Cryptocurrency address
  • Location data
  • Mailing address

By providing Company with User’s personal information, the User also consents for the Company to collect, hold, use and disclose the User’s personal information in accordance with this Policy. In addition to providing the foregoing information, if the User chooses to correspond further with the Company through e-mail or through the “contact” section of the Website or official social networks of the Company, the Company may retain, use and disclose the content of the User messages together with e-mail address and responses.

If the Company is not able to relate a direct link to the User personally, this information is not personal data.

3. The Information which is collected automatically

When the User uses the Website or Services, the Company can automatically collect information from User devices. The Company collects the following information:

  • Server Log Information: the Company can collect server log information when the User uses the Website, which may include (but is not limited to) the User login details, the date and time of visits, the pages viewed, IP address, time spent at the Website and the websites visited just before and just after the Website.
  • Device Information: the Company can collect information about the computer or mobile device the User uses to access the Website, including the hardware model, operating system and version, the web browser which used, and other device identifiers.
  • Telemetry Information. If the User employ any of the Company open source software, the Company may collect bandwidth upload and download speeds, the amount of free and used storage space on the User device and other statistics about devices.
  • Usage Information. If the User uses the Website, the Company will collect metadata about the files the User uploads for storage and the Company will record instances in which the User has used the private key to authenticate communications.
  • Information Collected by Cookies and Other Tracking Technologies: The Company and the Company’s service providers can use various technologies to collect information when the User interacts with the Website, including cookies and web beacons. Cookies are small data files that are stored on the User devices when they visit a website, which enable the Company to collect information about the device identifiers, IP address, web browsers used to access the Website, pages or features viewed, time spent on pages, mobile app performance and links clicked. Web beacons are graphic images that are placed on a website or in an email that is used to monitor the behavior of the user visiting the website or sending the email. They are often used in combination with cookies.

4. Protection of sensitive information

Company doesn’t collect or process sensitive information about User, such as: racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, and the processing of genetic data, biometric data for the purpose of uniquely identifying a natural person, data concerning health or data concerning a natural person’s sex life or sexual orientation.

5. Usage and storage of Information

The Company will only use and store the Information for purposes of:

  • providing, maintaining, or delivering the Services;
  • analyzing and tracking data to determine the usefulness or popularity of certain content and to better understand the online activity of the Users on Website;
  • fulfilling the applicable legal or regulatory requirements;
  • providing User with the information or products or services that have requested;
  • answering User inquiry or responding to a communication;
  • improving existing Service;
  • developing new products or services;
  • sending to User technical notices, support or administrative notifications;
  • communicating with User about news, products, services, events and other information the Company think will be of interest to the User;
  • monitoring and analyzing trends, usage and activities in connection with the Website;
  • detecting, investigating and preventing fraudulent transactions or unauthorized or illegal activities;
  • protecting the rights and property of the Company’s Parties (as defined below) and others;
  • linking, connecting or combining Information the Company collect from or about the User with other Information; and
  • carrying out any other purpose or reason for which the Information was collected.

The personal data will be erased in case the data are no longer necessary in relation to the purposes for which they were collected. Company will process personal data for the duration of your subscription/ usage of service and will remove the personal data from our records after cancellation.

The information stored on distributed ledger should be managed by User or Company on behalf of the User. The data stored by User or Company on behalf of the User on a distributed ledger cannot be deleted by Company due to technological restrictions.

In case the User wants the Company to delete the User personal data or revoke consent granted to Company for certain processing of the User personal data, User shall contact the Company. User may update the User’s personal information by submitting requests in writing to [email protected]

6. Users’ rights:

Users have the following rights:

  • ask Company to confirm whether Company is processing the User’s personal information;
  • receive information on how the User’s data is processed;
  • obtain a copy of the User’s personal information;
  • request that Company updates or corrects the User’s personal information;
  • request that Company deletes personal information in certain circumstances;
  • request that Company ceases processing of the User’s personal information:
    • for marketing activities, including profiling;
    • for statistical purposes;
    • with third specific party;
    • where such processing is based on Company legitimate business interests;
    • for processing the User’s personal information for the establishment, exercise or defense of a legal claim;
  • request that Company limits the processing of the User personal information:
    • while Company is evaluating or in the process of responding to a request by User to update or correct the User’s personal information;
    • where such processing is unlawful and User do not want Company to delete the User’s data;
    • where Company no longer requires such data, but User want Company to retain the data for the establishment, exercise or defense of a legal claim;
    • where User has submitted an objection to processing based on Company legitimate business interests, pending Company response to such request.

7. Sharing of Information

We will only share Information about User in the following ways:

  • with the User consent or at the User instruction;
  • with Company current or future parent companies, affiliates, subsidiaries and with other companies under common control or ownership of Company internationally;
  • with third parties or service providers that perform work for Company;
  • certain information the User may choose to share may be displayed publicly, such as the User username and any content the User post when the User use interactive areas of the Website like the Company online forums;
  • in connection with a merger or sale of the Company or Company’s business assets, or if the Company does a financing or are involved in an acquisition or any other situation where Information may be disclosed or transferred as Company or Company’s business assets;
  • in response to a request for information if the Company believes disclosure is in accordance with, or required by, any applicable law, regulation or legal process;
  • if the Company believes that User actions are inconsistent with Company user agreements or policies, or to protect the rights, property and safety of any Company Party or others; and
  • with third parties where aggregate Information is disclosed, which cannot be reasonably be used to identify the User.

We also seek to require our affiliates and service providers with whom we can share personal information to exercise reasonable efforts to maintain the confidentiality of Users personal information.

8. Social Sharing Features

The Website may offer social sharing features, links to social media and other integrated tools. User use of such features enables the sharing of information with the User contacts or the public, depending on the settings, with the entity that provides the social sharing feature or social media. Please visit the privacy policies of the entities that provide these features to obtain more information about the purpose and scope of data collection and the processing of such data by such entities.

9. Protection of Personal Information

The Company takes reasonable steps to protect the security of the information communicated through the Website. Personal data the Company collects is stored on protected servers. Access is restricted to a limited number of authorized persons who need the access in order to administer the Company platform, the Website and the Services or ensure their proper functionality, especially with regard to technical support. However, no computer security system is entirely foolproof and the Internet is not a secure method of transmitting information. As a result, the Company does not assume any responsibility for data the User submits to or receives from the Company through the Internet or for any unauthorized access or use of that information and the Company cannot and does not guarantee that information communicated by the User to the Company or sent to the User by the Company will be received or that it will not be altered before or after its transmission to the Company. the User agrees not to hold the Company and the Company respective past, present and future employees, officers, directors, contractors, consultants, advisors, equity holders, suppliers, vendors, service providers, founders, parent companies, subsidiaries, affiliates, agents, representatives, predecessors, successors and assigns (collectively, the “Parties”) liable for any loss or damage of any sort incurred as a result of any misappropriation, interception, modification, deletion, destruction or use of information provided through the Website.

Most web browsers are set to accept cookies as a default. The User may wish to opt out by turning off cookies (please refer to the help menu on the User browser); however, switching off cookies may restrict the User usage of the Website.

The User may also opt out of receiving promotional communications from the Company at any time by writing to [email protected] If the User opts out, the Company may still send to the User non-promotional communications, such as technical notices, support or administrative notifications or information about the User account, while account exists.

10. Hyperlinks and Third-Party Sites

The Website may contain links to other third party websites that may collect personal information about the User, including through cookies or other technologies. If the User links to another website, the User will leave the Website and this Privacy Policy will not apply to the User use of and activity on those other websites. The User should consult these other websites privacy policies as the Company has no control over them and are not responsible for any information that is submitted to or collected by these third parties.

11. Changes to Company Privacy Policy

Company may change this Policy in its sole discretion at any time. Any revisions to this Policy will be posted on the Website. It is User obligation to periodically, at least every thirty (30) days visit the Website to review any changes that may be made to this Policy. User continued use of the Website constitutes User agreement to be bound by any such changes to this Policy. If User does not agree with this Policy, User is not authorized to use the Services.

12. Contact the Company

Company Data protection officer will respond to all requests within 20 days of Company receipt of the request, unless there are extenuating circumstances, in which event Company may take up to 30 days to respond. Company will inform User if we expect our response to take longer than 10 days. Please note, however, that certain personal information may be exempt from such rights pursuant to applicable data protection laws. In addition, Company will not respond to any request unless Company is able to appropriately verify the requester’s identity. Company may charge User a reasonable fee for subsequent copies of data that User request.
